Terms

Draft. This text describes the rules the site actually runs by - it is written from the code and the decisions taken so far. Whether it holds up as a contractual term is for somebody who can stand behind that to review. The passages marked […] are decisions nobody has taken yet.

This is a translation. In case of doubt the German version applies: it is the text the site is operated under, and a translation cannot create rights the original does not grant.

1. What this is

CleanUpYourCity is a free platform on which people and organisations publish dates for collecting litter and others sign up for them. We provide the site. The actions themselves are run by the users.

There is no claim to constant availability. We aim for reliable operation but cannot guarantee it.

2. Your account

You need no account to look around. Anybody wanting to sign up for an action or run one creates one. The following applies:

  • An account belongs to one person. Credentials are not passed on.
  • The e-mail address must be yours and reachable - otherwise we cannot reach you when there is something to say about an action.
  • The display name is public. It must not infringe anybody's rights or insult anybody.
  • You can have your account deleted at any time - informally to info@cleanupyourcity.eu.

3. Actions

Whoever enters an action is responsible for it: for the details, for running it, and for it being lawful. That includes obtaining any necessary permissions - which may be required for land that is not publicly accessible, for riverbanks, nature reserves or railway property.

We look at every new action once before it becomes public. That check is a plausibility check, not an assurance: we do not verify that a permission exists, and approving an action does not make us its organiser.

We may refuse an action, or remove it later, if it breaks these rules or the law. When we refuse one, we say why.

4. What is not allowed

  • Advertising unrelated to the matter, and sales offers
  • Insulting, inciting, discriminatory or violence-glorifying material
  • Third-party content you have no right to - especially photographs in which other people are recognisable
  • Actions that do not exist, or dates nobody turns up for
  • Automated bulk sign-ups and anything that disrupts operation

5. Your content

What you enter stays yours. So that we can display it, you grant us the right to show it on this website and in our e-mails - no more. We do not sell it on and do not pass it to third parties.

An action other people took part in is their story too. If you have your account deleted, we agree with you beforehand what happens to it.

6. Taking part is at your own responsibility

Anybody coming to an action does so on their own responsibility. We are not the organiser and assume no duty to maintain safety.

7. Liability

We are liable without limitation for intent and gross negligence, and for injury to life, body or health. For ordinary negligence we are liable only for breach of material contractual obligations, limited to the foreseeable, typical damage. Otherwise liability is excluded.

8. Changes

We may change these rules when the service changes. Account holders are told about material changes by e-mail. The version published here at the time applies.

9. Applicable law

German law applies. Mandatory consumer protection provisions of the country in which you usually reside remain unaffected.
